TERMS & CONDITIONS

Welcome to Lux Photo and Video. By booking our services, accessing our client portal, or downloading delivered media, you ("Client," "Agent," or "Broker") agree to be bound by the following Terms & Conditions.

 

1. Property Readiness & Liability

  • Home Status: The Client is responsible for ensuring the property is clean, staged, open, and ready for photography at the scheduled shoot time.

  • Photographer Safety & Constraints: Our photographers are not responsible for moving furniture, cleaning, clearing clutter, or staging rooms due to safety, schedule constraints, and liability.

  • As-Is Capture: We shoot the property "as-is." If a property is not ready upon arrival, we reserve the right to cancel or reschedule, and a rescheduling fee may apply.

 

2. Cancellations, Rescheduling & Weather

  • Notice Period: We require at least 24 hours' notice for any cancellations or rescheduling requests. Cancellations or reschedules made under 24 hours may incur a fee of $150.00.

  • Inclement Weather: In the event of severe weather (heavy rain, high winds affecting drones, dense fog), we will try to capture the interior media as scheduled. Exterior or drone captures can be rescheduled for the next available opening at no additional cost.

 

3. Media Copyright & Usage Licensing

  • Ownership: Lux Photo and Video retains full copyright ownership of all digital media produced (photographs, videos, 3D tours, and aerial footage).

  • Limited License: Clients are granted a limited, non-exclusive, non-transferable license to use the delivered media solely for the purpose of marketing the active property listing.

  • Expiration & Transfer: This license expires once the property is sold, leased, or the listing agreement terminates. Media cannot be sold, gifted, or transferred to a third party (such as a future homeowner, builder, stager, or another real estate agent) without our written consent.

4. SMS Text Messaging Communications

By providing your mobile phone number and opting in to receive communications from us, you agree to receive SMS text messages from Lux Photo and Video.

  • Message Types: Customers can expect to receive text messages regarding appointment reminders, scheduling updates, photographer arrival alerts, and media order delivery notifications.

  • Message Frequency: Message frequency may vary depending on your active bookings and order status.

  • Rates: Message and data rates may apply.

  • Opt-Out: To opt out of text communications at any time, text STOP. After texting STOP, you will receive one final message confirming you have been unsubscribed.

  • Policies: Please view our Privacy Policy to understand how we protect your contact data.

 

5. Payments, Delivery & Paywalls

  • Pay-to-Download: All media files are delivered through our secure host platform, HDPhotoHub.

  • Payment Terms: High-resolution unwatermarked media files will remain locked behind a paywall until payment for the invoice is processed in full.

  • Late Fees: Invoices left unpaid for more than 30 days are subject to a monthly late fee on the remaining balance.

6. Drone & Aerial Services (FAA Compliance)

  • Safety Restraints: All drone operations are conducted by an FAA Part 107 certified pilot.

  • Flight Authorization: We reserve the right to cancel drone operations at any moment if flight conditions become unsafe due to weather, airspace restrictions (LAANC), or physical hazards (overhead powerlines, trees). No drone flights will be conducted over crowds of people.
