• Property Data: Listing addresses, lockbox codes, gate access instructions, square footage, and property attributes.
• Visual Assets & Media: Photographs, video footage, aerial/drone captures, 3D virtual tours (e.g., Zillow 3d tour), and floor plans.
• Technical Metadata: EXIF data embedded in image/video files, which can include geographic camera coordinates, timestamps, and camera hardware profiles.
2. How We Use Your Information
• To schedule real estate photography shoots and coordinate physical property access.
•To communicate appointment reminders, scheduling changes, and arrival alerts via phone, email, and SMS text messaging.
• To process payments, handle invoicing, and manage your account history.
• To deliver digital assets (photos, videos, virtual tours, and property flyers) via our white-labeled online portal.
• To fulfill commercial marketing licenses for the promotion of active real estate property listings.
3. Property & Occupant Privacy Safeguards
• While capturing real estate media, we make commercially reasonable efforts to protect the privacy of the property's occupants. Our media capture focuses on the architectural and structural layout of the building. We actively attempt to avoid photographing highly personal or identifying materials (such as visible personal family photographs, sensitive paper documents, or visible vehicle license plates). Any such elements captured inadvertently are routinely blurred, cropped, or edited out during our post-production process before final delivery.
4. Visual Asset Copyright & Licensing
• All copyrights for digital media assets (photographs, videos, 3D tours, and graphic layouts) remain the exclusive intellectual property of Lux Photography. By purchasing our services, clients are granted a limited, non-transferable, non-exclusive marketing license to use the media assets solely for marketing the specific property listing. We reserve the structural right to archive, distribute, and display these media assets within our company design portfolios, website showcases, social media accounts, and general promotional materials.
5. Third-Party Infrastructure Disclosures
• We do not sell your personal or property data to third parties. However, we securely share your data with critical third-party ecosystems required to fulfill our services:
• HDPhotoHub: Our central business infrastructure software. HDPhotoHub processes your order submissions, hosts client accounts, handles automated media delivery paywalls, and generates single-property marketing websites.
• Payment Gateways: Financial information is encrypted and handled directly by compliant payment processors (such as Stripe) integrated via HDPhotoHub. We do not store full credit card details on our local systems.
Mobile Information and SMS Privacy Disclaimer:
We value your privacy regarding text communications. SMS consent and phone numbers will not be shared with third parties or affiliates for marketing or promotional purposes. No mobile opt-in data will be shared with third parties for any reason. Your mobile information is kept strictly confidential and is used solely to provide operational updates regarding your scheduled photography bookings and media orders.
6. Drone & Aerial Data (FAA Part 107 Compliance)
• For properties requiring drone photography, we capture aerial media strictly within boundaries authorized by the FAA and local regulations. We make reasonable efforts to exclude surrounding neighbor properties, private yards, and visible individuals from the final framed drone media deliverables.
